Terms and Conditions

By engaging Safe Locate you agree to the following terms and conditions,  It is agreed that Safe Locate will  locate  the underground services in the prescribed locate area, surface mark  the locate site as per AS 5488.1 -2019.   Surface mark and Identify the assets as per the Australian standard for the purpose of guidance and avoidance,  Safe Locate will be indemnified from any responsibility what so ever for any damage to assets or injury caused due to the negligence or failure to use information provided by Safe Locate and asset owners regarding the Locate site,  it is recommended that Contractors or Third parties use safe digging procedures and hand dig or use non destructive digging methods to uncover  identify and validate the exact spacial position and depth of an asset before excavation.

Unless instructed otherwise Safe Locate will undertake Asset Locating as follows-  Obtain DBYD Asset owner plans-  Survey Asset owner plans prior to site visit-Walk and Inspect the Locate site - Locate assets that can be located up to QL-B.   QL-C.  QL-D.  Provide a Passive sweep of the area  - Surface Mark Up the Site.   It is your responsibility to  read all  asset owners information and disclaimers, and  make these available  to staff or contractors prior to digging or excavation.  Unless a Quality Level A (QL-A)  "Pot Holing " and the asset  has been sighted,  excavation should not take place.  The Locate has been undertaken with Avoidance as the main objective,  Safe Locate is indemnified from all responsibility  for any damage done by Contractors and Third Parties due to negligence or failure to use safe excavation practices and the failure to Pot Hole  prior to site works.  Extreme care must be used when excavating and digging,  we recommend hand excavation or non destructive digging methods where the potential for damage or injury exists.    (Use Air Digging - Hydro Excavation - Hand Digging - Excavators with Toothless Buckets - Have  Spotters  on site  when excavation takes place)  At your request Safe Locate can provide you a copy of the asset owners plans via download or email (zip file) or you can request these from the DBYD service.

The Absolute Identification and Validation of an assets requires  Pot Holing,  the exact location can only be achieved by physically exposing the asset.    Using a non destructive method,  dig down to the top of the assets and down  the side to the bottom of the asset,  sight the asset and take a depth measurement of that asset, confirming the spacial position of the asset along it length)  Note:  "Quality Level A  May Not be Achievable " due to field situations , construction methods and geological conditions.  Safe Locate if Instructed will Pot Hole Assets  on a "cost plus basis", we will provide you pricing for this service.  

 

LOCATION Quality Level Standard.   (AS 5488.1-2019)                                                                                            

QL- (A) sighted, must be located, then potholed. Utility must be physically sighted and measured.            

QL- (B) traced, laterally, with depth detail, between two known points (i.e. two man holes)

QL- (C) aligned from surface features,

QL- (D) any other method (E.g. DBYD plans or As built drawings,only)               

 


Duty of Care  

It is your responsibility to identify the presence of any underground assets in and around your proposed dig site  . Please be aware, that not all asset owners are registered with the Dial Before You Dig service, "Use a Certified Locator"  to Trace and Mark Out the Underground services.  Private sites Require Potholes to establish the exact location of all underground assets using a hand shovel or non destructive digging, before using heavy machinery. Note: Even pot-holing needs to be undertaken with extreme care, common sense and employing techniques least likely to damage cables. For example - Hydro vacuum excavation. Ensure you adhere to any State legislative requirements regarding Duty of Care and safe digging requirements. If you damage an underground asset you MUST advise the asset owner immediately.  Organisations or excavators representing an organization have a Duty of Care to locate underground assets that are within the vicinity of any work site prior to any project commencement. Irrespective of size, any type of excavation work has the potential to damage assets located around the work site, leading to service interruptions, delays to the project, costly repairs and in the worst case scenario, injury or death.  You are required to comply with any legislative requirements regarding the protection of particular asset owners’ licensed infrastructure such as gas pipelines and transmission infrastructure. You have a duty to protect workers and the public from serious injury due to the rupture of an underground asset such as a natural gas pipe, high voltage electricity cable, petroleum or industrial gas pipe. Any damage to these assets can cause very serious damage to structures and potential injury to many people.  Minimise the potential for damage and loss of service due to damage or rupture of the same assets. Extensive networks can be closed down for long periods with serious consequences of disruption and may incur penalties to the person causing the damage. The repair and replacement can be very costly.  Where the risks require the accurate location to be proved and recorded, use a locator to confirm the position, then pothole by hand or use non-destructive excavation methods to find the asset and record its accurate position digitally on the plans for the excavator and other affected contractors.  Where the risks are less and chances of finding the asset from Dial before You Dig information are good, pothole by hand or use non-destructive excavation methods to find the asset at the excavation work site. It is important to recognise that not every asset is detectable, plans may have not been updated, and new services may have been installed by contractors who have not updated the utility plans.   Plans are supplied by third parties in good faith and Safe Locate cannot guarantee the completeness or accuracy of such information supplied by Third Parties. Use of such information is subject to and constitutes acceptance of these terms.

Payment Terms  and  Fees

Minimum call out fees apply, hourly rates then apply and are calculated in 20 minute increments,  A list of Service fees can be found on a copy of our Client Authorisation form provided to clients before we book and schedule services.  All Payments are due on completion, once payment has been received we will provide you access to important information associated with your located site via a download link.  This information could be crucial and required prior to you doing any digging or excavation at the site. 

 

Credit Account holders:  Payment terms are strictly 21 Days from the date of the invoice.

Late payments:   Safe Locate reserve the right to apply at their discretion, penalty interest to overdue accounts at the rate of  15% pa or 0.041% per day.

Credit will not be provided unless Safe Locates Credit Application has been completed and approved.

 

Privacy Statement

We understand that  users of this website are concerned about their privacy and personal information, and the confidentiality and security of any information that is provided,  information is automatically collected whenever anybody accesses this website,  information may be voluntarily supplied through on-line forms and e-mail for specific  purposes, Safe locate  will only use such information collected for the purpose for which it was supplied and such information will not be passed on by Safe Locate for any marketing purposes to Third Parties.  Safe Locate will only pass information on as required by law.
